TERMS OF SERVICE FOR LIVE2D COMMISSIONS

GenERAL TERMS

  • Prices are subject to change based on demand.

  • I have the right to reject any order for any reason.

Payment

  • Currency accepted is either USD or EURO and can be paid usually through Paypal, if not bank transfer.

  • Commissions can be paid either 100% upfront or split 50% upfront and 50% after the product is finished.

  • Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment.

  • Once the project is finished you will receive the Live2D model / artwork. Note that there is no physical product.

  • I do not provide source files, only the final product. Additional fees are required for source files (psd, clip, cmo3).

Process
& delivery

  • The time it takes to finish a Live2D commission is around 3 weeks to a month+ depending on factors such as health, the complexity of the commissioned piece and other works.

REVISIONS

  • You may request unlimited revisions at the sketch phase, only minor revisions when sent the final model/final artwork. Any revisions deemed as major will require you to pay.

  • A fee will be added if you want something changed on the model / artwork - unless a misunderstanding from my side has been made.

  • If you wish for me to change something in the Live2D model / artwork you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make.

  • If your reference is unclear to start with, changes will come at an extra charge.

Copyright
& usage

I, Baguette (the artist):

  • I reserve the right to cancel and refund the order at any time for any reason.

  • Live2D models commissioned are considered commercial-use. Note that it is different for Live2D artwork made by me.

  • I will NOT claim the intellectual property (IP) of the Live2D commission.

  • I will NOT profit further from the Live2D commission unless you (the customer) break any of the terms.

  • I will tease the Live2D commission on social medias unless stated otherwise.

You (the customer/commissioner):

  • You may use the commissioned Live2D model/artwork for making content such as streaming/videos, etc.

  • You may NOT alter the commissioned Live2D without my (the artist's) consent.

  • You retain the rights to the intellectual property (IP).

  • If it is an original Live2D artwork from me, you may only use it for entertainment purposes unless you bought the commercial rights.

The following is considered copyright infringement:​

  • Reproducing/Using the copyrighted work (excluding Live2D models for using) commercially is not allowed except if you bought the commercial rights.

  • Claiming the Live2D model/artwork as your own.

  • Altering the Live2D model/artwork without my consent.

Cancellation
& Refund policy

  • The buyer is not allowed a refund once I started working on the commission.

  • If for any reason I am unable to start your commission you will receive a full refund.

  • If you cancel your order before I started it, you can get a full refund.

  • If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.

  • You retain the rights to the intellectual property (IP).

  • If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.

What do you get?

  • WIP pictures/videos of the commissioned Live2D during the production process to make sure I can continue the commission safely. If you are curious, I stream the whole creation process on my Twitch channel unless it is under NDA.

  • Rigged and ready-to-use Live2D model files or Live2D Art with PNG of the model/illustration.

  • I provide the source files (psd, clip, cmo3, aep) if you paid the extra fees for it or if it is a Live2D model/art only commission.
